These Terms of Service ("Terms") apply to your use of toutenuit.com (the "Site") and to any purchase you make on it. The Site is operated by Mimiko, Inc., doing business as Toute Nuit ("Toute Nuit," "we," "us"). By using the Site or placing an order, you agree to these Terms, our Refund Policy and our Privacy Policy.

1. Eligibility

You must be at least 18, or the age of majority where you live, to buy from the Site.

2. Our products

Toute Nuit patches are cosmetic products made of hypoallergenic, latex-free medical-grade tape. They are not a medical device and are not intended to diagnose, treat, cure or prevent any disease. Use them only as directed: apply to clean, intact skin; don't use on broken, irritated or sunburned skin; patch test first; and stop using them if irritation persists. Results vary from person to person. Product images and descriptions are for illustration, and actual products may vary slightly.

3. Orders and pricing

All orders are subject to acceptance and availability. We may refuse or cancel any order, including orders that appear fraudulent or were placed for resale, or orders where the price or product information was wrong. If we cancel an order you've already paid for, we'll refund you in full. Prices are in the currency shown at checkout and may change without notice. Discount codes and promotions have their own terms, cannot be combined unless stated, and have no cash value.

4. Payment

You authorize us and our payment processors to charge your chosen payment method for your order total, including shipping and applicable taxes.

5. Subscriptions (Subscribe & Save)

• Your plan renews automatically at the interval you selected, and your payment method is charged for each delivery until you cancel.
• Subscriptions have a minimum of 2 deliveries. After your 2nd delivery you can cancel at any time from your account.
• You can skip or pause a delivery, or change your products, before the renewal date.
• We'll tell you before any change to your subscription price takes effect.

6. Shipping

We ship to the addresses and countries shown at checkout. Delivery times are estimates, not guarantees. Risk of loss passes to you when your order is handed to the carrier. For international orders, you are the importer of record and are responsible for any duties, taxes and customs fees.

8. Your account

You are responsible for keeping your login secure and for activity on your account. Please give us accurate contact and shipping information. We are not responsible for orders sent to an address entered incorrectly at checkout.

9. Reviews and content you submit

By submitting reviews, photos, comments or other content, you give us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with Toute Nuit. You confirm the content is yours, is truthful, and doesn't infringe anyone's rights. We may remove content at our discretion.

10. Intellectual property

The Site and its content, including the Toute Nuit name and logo, text, images, videos and designs, are owned by Mimiko, Inc. or its licensors and are protected by law. You may not copy, reproduce or use them commercially without our written permission.

11. Acceptable use

You agree not to misuse the Site, including by attempting to interfere with its operation, scraping it with automated tools, placing fraudulent orders, or using it for any unlawful purpose.

12. Third-party links and services

The Site may link to, or rely on, third-party services such as payment processors, subscription tools and review platforms. We aren't responsible for their content or practices.

13. Disclaimer

Except as stated in these Terms or required by law, the Site and products are provided "as is," without warranties of any kind, express or implied.

14. Limitation of liability

To the fullest extent permitted by law, Toute Nuit is not liable for any indirect, incidental or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product that gave rise to it. Some jurisdictions don't allow these limits, so they may not apply to you.

15. Indemnity

You agree to indemnify Toute Nuit against claims arising from your breach of these Terms or your misuse of the Site.

16. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.

17. Changes

We may update these Terms from time to time. The "Last updated" date shows the latest version. Continuing to use the Site after a change means you accept it.
